«Либертарианская утопия», или демократия и конституционный строй Лихтенштейна

Abstract

Анализируются вопросы конституционного оформления идей прямой демократии, права на самоопределение местных общин, законодательной инициативы граждан, плебисцитарного принятия законов, самоограничения государства. Изучаются вопросы ограничения бюрократического аппарата сильной властью главы государства и элементами прямой демократии, расширением прав местных общин, передачей последним большинства социальных функций государства, его функций по регулированию культурной жизни, образования, налогообложения. Особое внимание уделяется праву сецессии местных общин как гарантии мирного развития государств, обеспечения прав и свобод граждан и местных сообществ. Исследуется практика формирования смешанной формы правления в ХХІ в. Данная проблематика рассматривается через призму реализации либертарианских идей в Княжестве Лихтенштейн. Изучается идейное обоснование реформирования современного государства в духе либертарианства как ответ на вызовы эпохи глобализации, содержащееся в работе Наследственного князя Лихтенштейна Ханса Адама ІІ.=Article is devoted to fix in the Constitution the ideas of direct democracy, the right of local communities to self-determination, the citizens' legislative initiative, the adoption of laws on the referendum, self-limiting government. The publication deals with the questions of limiting bureaucracy by the strong presidential power and by the elements of direct democracy, the empowerment of local communities, implementation of local communities, the majority of the social functions of the state and its functions to regulate cultural life, education, and taxation. Special attention is paid to the right of secession of local communities as a guarantee of the peaceful development of the states, the rights and freedoms of citizens and local communities. The publication explores the practice of forming a mixed form of government in the XXI century. This problem is considered realization of libertarian ideas in the Principality of Liechtenstein. We study the ideological justification for the reform of the modern state in the spirit of libertarianism, contained in the Hereditary Prince of Liechtenstein Hans Adam II' book.
