Правовая регламентация отношений в сфере банковского кредитования: история и современность

Abstract

Посредством анализа основных исторических памятников права рассмотрены этапы и особенности развития законодательства, регулирующего общественные отношения в сфере банковского кредитования. Правовое регулирование распространялось как на форму кредитных отношений, так и на их условия. По мере развития цивилизации, изменения политической и экономической формации общества закономерно эволюционировали и кредитные отношения, а также их правовое регулирование. Законодательство советской России и первые законы БССР деяния в банковско-кредитной сфере рассматривали как преступления против порядка управления либо как хозяйственные или имущественные преступления. В настоящее время преступления в сфере банковского кредитования выделены в отдельную главу Уголовного кодекса Республики Беларусь «Преступления против порядка осуществления экономической деятельности».= Through the analysis of the main historical monuments of law, the stages and peculiarities of the development of legislation regulating public relations in the sphere of bank lending are examined. It is noted that with the emergence of property relations emerged the simplest credit relations and, accordingly, the rules of law that regulate them. Legal regulation extended both to the form of credit relations, and to their terms. With the development of civilization, changes in the political and economic formation of society, credit relations, as well as their legal regulation, naturally evolved. Legislation of Soviet Russia and the first laws of the BSSR acted in the banking and credit sphere as crimes against the order of government or as economic or property crimes. At present, crimes in the sphere of bank lending have been singled out in a separate chapter of the Criminal Code of the Republic of Belarus “Crimes Against the Procedure for the Implementation of Economic Activities”.
