О некоторых вопросах подготовки решений органов местного управления и самоуправления

Abstract

Рассматриваются важные вопросы подготовки решений местных органов управления и самоуправления: внесение и рассмотрение нормотворческого предложения; принятие решения о подготовке проекта акта местного нормотворчества; финансовое и организационно-техническое обеспечение подготовки проекта решения; сбор материалов и информации по вопросам, предполагающим свое нормативное регулирование; разработка концепции проекта решения; составление текста проекта решения. Особое внимание уделяется содержанию данных мероприятий с точки зрения нормативного регулирования организационных мероприятий. Автор статьи обращает внимание на необходимость разработки концепции решения, независимо от статуса данного нормативного документа с точки зрения его юридической силы. Проводится анализ основных нормативных документов, регулирующих вопросы подготовки решений органов местного управления и самоуправления. Статья подготовлена с учетом вновь принятого Закона «О местном управлении и самоуправлении в Республике Беларусь» от 4 января 2010 года. = In article the important questions of preparation of decisions of local controls and self-management are considered: entering and consideration offers for creation of norms; decision-making on preparation of the project of the act of local creation of norms; financial and organizational-technical maintenance of preparation of the project of the decision; gathering of materials and the information on the questions assuming the standard regulation; working out of the concept of the project of the decision; drawing up of the text of the project of the decision. The special attention is given to the maintenance of the actions from the point of view of standard regulation of organizational actions. The author of article pays attention to necessity of working out of the concept of the decision, irrespective of the status of the given standard document from the point of view of its validity. The analysis of the basic standard documents regulating questions of preparation of decisions of local authorities and self-management is carried out. Article is prepared taking into account again accepted Law «About local management and self-management in the Republic of Belarus» from January, 4th, 2010.
