Формы правоохранительной деятельности таможенных органов и особенности их реализации

Abstract

Рассматриваются особенности правоохранительной деятельности таможенных органов Республики Беларусь, освещаются особенности правового статуса таможенных органов как правоохранительных органов с позиции норм Таможенного кодекса Таможенного союза, Таможенного кодекса Евразийского экономического союза, Закона Республики Беларусь «О таможенном регулировании в Республике Беларусь» и иных документов. Акцентировано внимание на научных подходах к определению форм правоохранительной деятельности, а также изучены их особенности. Отмечена неоднородность трактовки как самой правоохранительной деятельности, так и ее форм. На основании проведенного анализа форм правоохранительной деятельности предложена и обоснована собственная классификация форм правоохранительной деятельности таможенных органов Республики Беларусь.=The peculiarities of law enforcement activity of customs bodies of the Republic of Belarus are considered in the article, particularities of the legal status of customs bodies as law enforcement bodies from the standpoint of the norms of the Customs Code of the Customs Union, the Customs Code of the Eurasian Economic Union, the Law of the Republic of Belarus "On Customs Regulation in the Republic of Belarus" and other documents are highlighted. In the system of customs bodies, the status of state law enforcement bodies is attached to the State Customs Committee of the Republic of Belarus and customs. The author draws attention to the approaches of scientists to the definition of forms of law enforcement activity, and also reveals their essential features. It should be noted that scientists interpret both law enforcement activities and its forms are not uniform. Based on the analysis of forms of law enforcement activities allocated by scientists, the author proposes and justifies his own classification of forms of law enforcement activity of the customs bodies of the Republic of Belarus.
