Ремедиация как механизм правовой охраны земель: постановка проблемы

Abstract

Анализируются вопросы совершенствования законодательной регламентации в сфере охраны земель. Ремедиация рассматриваются как направление правовой охраны земель по законодательству Республики Казахстан. Раскрываются и сравниваются такие понятия, как рекультивация, оценка ущерба и ремедиация, в совокупности определяющие восстановление земель. Анализируются нормативные правовые акты, регулирующие рекультивацию, консервацию земель, экономическую оценку ущерба; выявляется общее для этих понятий содержание – восстановление земель до первоначального состояния. Исходя из общих подходов к ремедиации в экологическом законодательстве, обосновывается содержание данного термина с целью охраны земель. В силу того, что ремедиация применяется в большей степени к охране земель, авторы обосновывают необходимость введения мер ремедиационного характера в земельное законодательство с учетом особенностей охраны и защиты земель как компонента окружающей среды. Представлена авторская формулировка ремедиации применительно к земельным правоотношениям. Предлагается введение данного понятия в земельное законодательство Республики Казахстан.= This article is devoted to the issues of improving the legislative regulation in the field of land protection. In particular, the authors investigate remediation as a direction of the legal protection of lands under the legislation of the Republic of Kazakhstan. Such concepts as reclamation, damage assessment and remediation, which together define land restoration, are revealed and compared. Analyzed regulatory legal acts regulating the reclamation, conservation of land, economic assessment of damage and identifies the general content of these concepts – the restoration of land to its original state. Based on the general approaches to remediation in environmental legislation, the content of this term is justified in order to protect land. Due to the fact that remediation is applied to a greater extent to land protection, the authors substantiate the need to introduce remediation measures into land legislation, taking into account the features of land protection and protection as a component of the environment. The author’s formulation of remediation is given in relation to land legal relations. The introduction of this concept into the land legislation of the Republic of Kazakhstan is proposed.
