О некоторых вопросах властных полномочий надзорных органов

Abstract

Статья посвящена исследованию деятельности надзорных органов на примере Госэнергогазнадзора в части государственного энергетического надзора. Автором проводится сравнительно-правовой анализ компетенции Госэнергогазнадзора и других органов по двум критериям: единства властных полномочий и четкости их разделения по ведомственному признаку. В результате выявляются трудности однозначной идентификации предметной области деятельности надзорных органов. В связи с этим одни и те же вопросы могут оцениваться несколькими органами, дублируя друг друга, либо напротив, оставаться вне поля зрения. На основе проведенного исследования формулируются причины и предпосылки, повлекшие такие обстоятельства, а также вырабатываются предложения, направленные на преодоление сложившейся ситуации в целях формирования прозрачного взаимодействия надзорных органов с субъектами воздействия.= The article is devoted to the study of the activities of supervisory authorities on the example of Gosenergogaznadzor in terms of state energy supervision.The author carries out a comparative legal analysis of the competence of Gosenergogaznadzor and other bodies according to two criteria: the unity of power and the clarity of their separation according to departmental grounds.As a result, the difficulties of unambiguous identification of the subject area of activity of supervisory authorities are revealed.In this regard, the same issues can be assessed by several bodies, duplicating each other, or vice versa, remain out of sight. On the basis of the study, the reasons and prerequisites that led to such circumstances are formulated, and proposals are developed that are aimed at overcoming the current situation in order to create a transparent interaction of the supervisory authorities with the subjects of influence.
