| dc.description.abstract | В статье приводится систематизация существующих факторов правообразования, обусловленных содержанием общественных отношений в цифровой экономике. К числу внешних факторов автор относит: закономерности цифровых технологий; цифровую трансформацию экономических отношений, в том числе действие специфических экономических законов и условий производства, характерных исключительно для цифровой экономики; социальные и социокультурные трансформации отношений в цифровой среде. Показано, что указанные процессы формируют новые запросы на правовое регулирование, обусловливают возникновение ранее неизвестных объектов регулирования и трансформируют структуру общественных отношений. Особое внимание уделяется внутренним (обеспечивающим) факторам правообразования, связанным с адаптационным потенциалом правовой системы. К ним отнесены: расширение пределов правового регулирования, развитие рефлексивных и инструментальных моделей права, формирование технологически ориентированных принципов регулирования, появление цифровых форматов изложения правовых норм и интерактивных процедур нормотворчества, развитие юрисдикционных моделей и механизмов. Сделан вывод о том, что правообразующая природа цифровой экономики проявляется во взаимодействии технологических, экономических и социальных факторов, которые формируют новые условия развития правовой системы и требуют разработки современной теоретикоправовой модели правового регулирования. | ru_RU |

| local.description.annotation | The article systematizes the existing factors of law formation, conditioned by the nature of social relations in the digital economy. The author attributes the following external factors: the digital technology patterns; the digital transfor-mation of economic relations, including the effect of specific economic laws and production conditions characteristic exclu-sively of the digital economy; and social and socio-cultural transformations of relations in the digital environment. It is shown that these processes are generating new demands for legal regulation, leading to the emergence of previously un-known regulatory objects, and transforming the structure of social relations. Particular attention is paid to the internal (enabling) factors of lawmaking associated with the adaptive potential of the legal system. These include: the expansion of the scope of legal regulation, the development of reflexive and instrumental legal models, the formation of technology-ori-ented regulatory principles, the emergence of digital formats for presenting legal norms and interactive rulemaking proce-dures, and the development of jurisdictional models and mechanisms. It is concluded that the law-making nature of the digital economy is manifested in the interaction of technological, economic, and social factors, which shape new conditions for the development of the legal system and require the development of a modern theoretical model of legal regulation. | ru_RU |
