| dc.description.abstract | В статье исследуется ряд аспектов, касающихся целей, оснований и пределов ограничения соматических прав человека, то есть прав, связанных с распоряжением человеком своим телом. На национальном конституционном уровне соматические права человека в качестве субъективных прав подробно закреплены не так широко, но получают свое отражение в актах текущего законодательства. Подчеркивается, что не все соматические права относятся к категории абсолютных, они могут быть ограничены. Проблема заключается в интерпретации существующих правил. При этом важно обеспечивать конституционную законность. В случае установления ограничений прав и свобод следует руководствоваться такими стандартами, как объективная необходимость введения ограничений, исключение дискриминации, соблюдение допустимых пределов ограничений. | ru_RU |

At the national constitutional level, somatic human rights are not extensively detailed as subjective rights, but they are reflected in current legislation. It is emphasized that not all somatic rights are absolute and can be limited, and the challenge lies in interpreting existing rules. It is crucial to ensure constitutional legality. When imposing restrictions on rights and freedoms, the following standards should be followed: the objective necessity of imposing restrictions, the exclusion of discrimination, and compliance with the per-missible limits of restrictions. | ru_RU |
