dc.descriptionThe category of «proportionality of constitutional values» is considered. The essence, content and significance of the named legal phenomenon are determined. The main properties of proportionality of constitutional values are investigated. It is proposed to consider it as a principle of law-making and law enforcement activities, as well as a presumption. The proportionality test is being studied as a tool based on the proportionality of constitutional values. The relationship of pro-portionality with the phenomenon of constitutional identity is noted. Using examples from the practice of constitutional justice, the specifics of value proportionality in the context of digitalization are shown. Examples of violation of the propor-tionality of constitutional values in the new realities are given. Ways of solving the identified problems are proposed.ru_RU
dc.description.abstractРассматривается соразмерность конституционных ценностей как правовые категория и явление. Определяются её сущность, содержание и значение. Исследуются основные свойства соразмерности конституционных ценностей. Предлагается её понимание как презумпции, принципа правотворческой и правоприменитель-ной деятельности. Изучается тест на пропорциональность в качестве инструмента, основанного на ценностной соразмерности. Отмечается её взаимосвязь с феноменом конституционной идентичности. На практике конституционного правосудия показывается специфика соразмерности в условиях цифровизации. Приводятся примеры нарушения соразмерности конституционных ценностей в новых реалиях. Выявляются проблемы и предлагаются пути их решения.ru_RU
