| dc.description | This article analyzes the new authority of the Constitutional Court of the Republic of Belarus to review the consti-tutionality of presidential elections, elections to the House of Representatives, and elections to the Council of the Republic, as enshrined in the 2022 referendum. It examines the procedural aspects of implementing this authority (the procedure for submitting a proposal to the Constitutional Court, deadlines, and grounds for issuing opinions). It identifies legal uncertainties in the regulation of the mechanism for implementing this authority, including the lack of criteria the Court should use when assessing the constitutionality of elections, the unresolved issue of the fate of unconstitutional regulations, and the exclusion of elections to local councils from the scope of review. | dc.description.abstract | В статье анализируется новое полномочие Конституционного Суда Республики Беларусь по проверке конституционности выборов Президента, депутатов Палаты представителей и членов Совета Республики, закрепленное по результатам референдума 2022 года. Рассматриваются процедурные особенности реализации данного полномочия (порядок внесения предложения в Конституционный Суд, сроки, основания для вынесения заключений). Выявляется правовая неопределенность в регламентации механизма реализации рассматриваемого полномочия, включая отсутствие критериев, которыми должен руководствоваться Суд при оценке конституционности выборов, нерешенность вопроса о судьбе неконституционного нормативного акта, исключение выборов в местные Советы из предмета проверки. Сформулированы предложения по совершенствованию законодательства о конституционном судопроизводстве. | ru_RU |
