Abstract

Представлен анализ отношений, связанных с использованием доменных имен. Выясняется правовая природа и сущность отношений, связанных с использованием доменных имен. Определены ключевые характеристики интернет-адресации. Выделены функциональные группы понятий Интернета. Показано, что регистрация и пользование доменными именами осуществляется, как правило, на договорной основе, что может служить базой для включения их в систему обязательственного права. Рассмотрен вопрос о возможности существования исключительного права на доменное имя, а также вопрос о возможности регулирования доменного имени нормами имущественного права. Исследована разработка национального законодательства в сфере Интернет, обеспечивающая адекватную защиту прав пользователей сети Интернет. Сделан вывод о необходимости определения статуса доменного имени и вытекающих из данного статуса прав и полномочий субъектов правоотношений, связанных с использованием доменных имен.= The author presents the analysis of the relations associated with the use of domain names, turns out the legal nature and essence of the relations associated with the use of domain names. Investigated the development of national legislation in the field of Internet that provides for adequate protection of the rights of Internet users. The author making a conclusion about the necessity of defining the status of domain name under this status, rights and powers of legal entities associated with the use of domain names.
