Совершенствование процедуры государственной регистрации юридических лиц как направление противодействия экономической преступности

Abstract

Рассматриваются криминальные риски действующей модели создания юридических лиц в организационно-правовой форме общества с ограниченной ответственностью. = The article describes the current model of criminal risks creating legal entities in the legal form of a limited liability company. Based on comparative legal analysis of the legislation of the various states highlighted the existing approaches to control the creation and activities of commercial organizations. It is concluded that in the Republic of Belarus in conditions of removing any proprietary restrictions to the registration of companies control over the legality of the creation of legal entities must be passed on to the registration authorities. In this connection, the state policy on the regulation of registration of legal persons in order to neutralize the establishment of fictitious legal persons requires its perfection in terms of granting special powers to verify the information on the future participants of economic societies.
