Направление и отрасль прокурорского надзора: понятие, сущность, соотношение

Abstract

Рассматривается проблема отсутствия в настоящее время в теории прокурорского надзора единого подхода к определению и содержанию ряда принципиальных категорий, таких как «направление прокурорского надзора» и «отрасль прокурорского надзора». Соотносятся данные понятия авторами также по-разному, что может вызвать определенного рода затруднения как в теории, так и в правоприменительной практике. Сделан вывод о необходимости обобщения и структурирования имеющихся точек зрения относительно анализируемых категорий. Предложена авторская позиция по этому вопросу.= The problem of absence one approach about definition and essence of a range of the principal categories such as “a direction of the prosecutor supervision” and “a branch of the prosecutor supervision” in the theory of the prosecutor supervision at the present time is considered. These notions are correlated in different way by authors too. It seemed to be in these way that absence of the sameness of these question can cause difficulties how in the theory so in practice. The conclusion about the necessity of the generalization and structuring of the existing points of view about analyzed categories and the proposal of the author’s position is given.
