К вопросу о становлении правосубъектности народа

Abstract

Рассматриваются вопросы зарождения идеи «народа» как носителя власти и субъекта правоотношений. Анализируются подходы к пониманию народа в теории естественного права, в советский период, а также в трудах современных правоведов. На первый план выдвигаются идеи представительства интересов народа, объема его прав и обязанностей. Акцентируются проблемные аспекты правосубъектности народа как одного из участников конституционных правоотношений.= The issues of origin of the idea of “people” as a bearer of power and subject of legal relations are considered. Approaches to the understanding of the people in the theory of natural law, in the Soviet period, as well as in the works of modern jurists are analyzed. Attention is paid to the problem aspects of the legal personality of the people, the scope of their rights and duties, as one of the participants in constitutional legal relations. Attention is focused on the representation of the interests of the people.
