Структура правового сознания в правовой теории в контексте современной психологии сознания: новые перспективы

Abstract

Рассматриваются подходы к структуре правового сознания в современной юридической науке. Анализируются взгляды отечественных и зарубежных ученых на структуру правового сознания. Подчеркивается, что подходы к структуре правосознания не изменялись за длительное время. Обозначаются достижения современной психологии сознания. Отмечается необходимость исследования правосознания с позиции психологической теории сознания. Рассматриваются подходы ученых к понятию и структуре сознания. Анализируется структура сознания, разработанная психологом В.П. Зинченко. Подчеркивается наличие в структуре сознания отношений гетерархии. Выделяются слои и образующие сознания. Дается характеристика бытийному, рефлексивному и духовному слоям сознания, а также их образующим. Отмечается связь структуры сознания со структурой правосознания. Обозначается перспектива разработки структуры правосознания на основании структуры сознания.= The approaches to the structure of legal consciousness in modern legal science are considered. The views of domestic and foreign scientists on the structure of legal consciousness are analyzed. Strata and forming consciousnesses are distinguished. A characteristic is given to the existential layer of consciousness, the reflective layer of consciousness and the spiritual layer of consciousness, as well as their generators. The connection between the structure of consciousness and the structure of legal consciousness is noted. The perspective of developing a structure of legal consciousness based on the structure of consciousness is indicated.
