Экспертиза в административном процессе: проблемы и пути совершенствования

Abstract

Рассматриваются актуальные вопросы использования результатов специальных знаний в административном процессе. Эти знания могут быть применены как в форме судебных экспертиз, так и в форме экспертиз, не обладающих статусом судебных. Вместе с тем единство научного способа познания доказательств позволяет говорить о сближении позиций в оценке результатов судебных и несудебных экспертиз при ведении административного процесса. Предлагается ряд рекомендаций по совершенствованию действующего административно-процессуального законодательства.= The article is devoted to topical issues of the use of the results of special knowledge in the administrative process. This knowledge can be used both in the form of forensic examinations, and in the form of expertise that does not have judicial status. At the same time, the unity of the scientific method of knowledge of evidence allows us to speak about the convergence of positions in assessing the results of judicial and non-judicial examinations in the conduct of the administrative process. A number of recommendations are proposed to improve the current administrative procedure legislation.
