Судовая сістэма на тэрыторыі Беларусі ў 1840 – 1872 гг.

Abstract

У артыкуле даследавана судовая сістэма, якая дзейнічала на тэрыторыі Беларусі ў 1840 – 1772 гг., у перыяд ад распаўсюджання на ўсю тэрыторыю края дзеяння тагачаснай расійскай мадэлі судаводства і судаўладкавання да пачатку рэалізацыі тут судовай рэформы 1864 г. Дадзеная судовая сістэма характарызавалася грувасткасцю судаўладкавання і архаічнасцю працэсуальных норм, што ў рэшце паставіла ўрад перад неабходнасцю правядзення карэннай рэформы правасуддзя. Судовая сістэма на тэрыторыі Беларусі ў разглядаемы перыяд у цэлым паўтарала агульнаімперскую. Разам з тым яна мела некаторыя асаблівасці, якія заключаліся ў пэўным абмежаванні, у параўнанні з унутрырасійскімі губернямі, правоў дваранства па выбарах на судовыя пасады.= The article presents a study of the judicial system that was in force in the territory of Belarus in 1840– 1772. – i.e. during the period from the moment of extending the Russian justice model to entire territory of the region to the beginning of implementation the judicial reform of 1864. This judicial system was characterized by cumbersome judiciary and archaic procedural rules. This ultimately put the government in front of the need for radical judicial reform. The judicial system on the territory of Belarus in the period under review generally repeated the imperial one. at the same time, it had some peculiarities, which consisted in a certain restriction, in comparison with the internal Russian provinces, of the rights of the nobility to elect judicial positions.
