Об основной функции суда в Республике Беларусь

Abstract

В статье проанализировано законодательство Республики Беларусь на предмет правового регулирования функций, выполняемых судами. Приведены позиции научного сообщества по данному вопросу. Сделан вывод о превалировании в качестве основной для суда функции – осуществление правосудия. Выделены современные формы проявления профилактической и воспитательной функции суда. Высказана авторская позиция по вопросу вынесения судами частных определений (постановлений).= The article analyzes the legislation of the Republic of Belarus for the legal regulation of the functions performed by the courts. The positions of the scientific community on this issue are presented. The conclusion is made about the preva-lence of the main function for the court - the administration of justice. The modern forms of manifestation of the preventive and educational functions of the court are highlighted. The author's position on the issue of private rulings (rulings) issued by the courts is expressed.
