| Abstract: | В связи со сравнительной новизной понятия «мультимедийное произведение» и отсутствием среди юри-стов единого подхода к его толкованию, актуальным является вопрос определения признаков, которые могли бы послужить основой для отграничения произведений такого рода от других объектов авторского права. В статье проанализированы и систематизированы теоретические положения по теме исследования, выделены и рассмотрены следующие признаки мультимедийного произведения: интерактивность; наличие в структуре совокупности нескольких результатов интеллектуальной деятельности; сложность; цифровая форма; виртуальность; наличие в структуре компьютерной программы; предоставление информации с помощью комбинации множества воспринимаемых человеком сред; наличие нескольких сюжетных линий; художественный дизайн интерфейса и средств навигации; воплощение на материальных носителях; необходимость использования специальных технических устройств для работы с мультимедийным произведением. Hа основании полученных результатов исследования выделены сущностные юридически значимые признаки мультимедийного произведения. |
| metadata.local.description.annotation: | In connection with the comparative novelty of the concept of "multimedia work" and the lack of a unified approach to its interpretation among lawyers, the issue of determining the signs that could serve as the basis for distinguishing works of this kind from other objects of copyright is relevant. The article analyzes and systematizes the theoretical provisions on the research topic, identifies and considers the following features of a multimedia work: interactivity; the presence in the structure of the totality of several results of intellectual activity; complexity; digital form; virtuality; the presence in the structure of a computer program; providing information using a combination of many perceived by the person; the presence of several storylines; artistic design of the interface and navigation tools; embodiment on material carriers; the need to use special technical devices for working with multimedia works. Based on the results of the study, the essential legally significant features of a multimedia work are highlighted. |
