| Abstract: | В статье исследуется правовая природа денег в контексте их монетарного регулирования. Обосновывается необходимость пересмотра традиционного подхода к пониманию денег, сложившегося в рамках гражданского и финансового права. Предлагается методологический подход к исследованию денег, основанный на их объектном, функциональном и ресурсном понимании, позволяющий раскрыть особенности их правовой природы и роль в системе монетарного (денежнокредитного) регулирования. Показано, что ключевая методологическая роль в правовом регулировании денег принадлежит монетарному и банковскому праву, тогда как подходы гражданского и финансового права имеют вспомогательное значение. На основании проведенного анализа обосновывается необходимость совершенствования нормативного регулирования правовой природы денег в законодательстве Республики Беларусь, включая нормы гражданского, банковского и валютного законодательства, а также законодательства в сфере противодействия легализации преступных доходов и финансированию терроризма. |
| metadata.local.description.annotation: | The article examines the legal nature of money in the context of its monetary regulation. The necessity of revising the traditional approach to the understanding of money formed within civil and financial law is substantiated. A methodological approach to the study of money is proposed, based on its object-based, functional, and resource-based understanding, which makes it possible to reveal the specific features of the legal nature of money and its role within the system of monetary regulation. It is shown that the key methodological role in the legal regulation of money belongs to monetary and banking law, whereas the approaches of civil and financial law perform an auxiliary function. Based on the conducted analysis, the necessity of improving the normative regulation of the legal nature of money in the legislation of the Republic of Belarus is substantiated, including the provisions of civil, banking and currency legislation, as well as legislation aimed at counteracting money laundering and the financing of terrorism. |
