| Abstract: | В статье анализируется правовая природа регистрации холдингов в Республике Беларусь. Приводится мнение ученых о необходимости установления регистрации холдингов и рассматривается зарубежный опыт формализации групп компаний. Ставится вопрос об отраслевой принадлежности норм, регулирующих порядок регистрации холдинга. Делается вывод о том, что несмотря на частноправовую сущность холдинга, нормы о его регистрации относятся к сфере административного права. Процедура регистрации холдинга является объектом межотраслевого регулирования, поскольку посредством норм административного права обеспечивается легитимация частноправового объединения. |
| metadata.local.description.annotation: | The article analyzes the legal nature of holding (groups of companies) registration in the Republic of Belarus. It presents the opinions of scholars on the necessity of establishing holding registration and examines foreign experience in the formalization of groups of companies. The question of the branch affiliation of the norms regulating the procedure for holding registration is raised. It is concluded that, despite the private-law essence of a holding, the norms governing its registration fall within the sphere of administrative law. The registration procedure itself is an object of inter-branch regulation, as the legitimation of a private-law association is ensured through the norms of administrative law. |
