| dc.description | The article examines conflicts between traditional customary practices and legal norms in the post-war Bela-rusian countryside, based on an analysis of court records, collective farm protocols, and ethnographic sources. The sources reveal an ambiguity in the qualification of identical peasant actions at the level of the collective farm community and law enforcement agencies. It is shown that religious-ritual and patriarchal-family practices continued to regulate the behaviour of rural residents and came into contradiction with state legal innovations (Decrees of 1947–1948) in the spheres of land use, labour discipline, and family relations. The transformation of traditional culture is considered as a process in which customs adapted to new socio-economic conditions while preserving their external form. | ru_RU |
| dc.description.abstract | Разглядаюцца канфлікты паміж традыцыйнымі звычаёвымі практыкамі і прававымі нормамі ў паслява-еннай беларускай вёсцы на падставе аналізу судовых спраў, калгасных пратаколаў і этнаграфічных крыніц. Крыніцы сведчаць пра неадназначнасць кваліфікацыі аднолькавых дзеянняў сялян на ўзроўні калгаснай грамады і праваахоўных органаў. Паказана, што рэлігійна-абрадавыя і патрыярхальна-сямейныя практыкі працягвалі рэгуляваць паводзіны вяскоўцаў і ўступалі ў супярэчнасць з дзяржаўнымі прававымі навацыямі (Указы 1947 – 1948 гг.) у сферах землекарыстання, працоўнай дысцыпліны і сямейных адносін. Трансфармацыя традыцыйнай культуры разглядаецца як працэс, у якім звычаі прыстасоўваліся да новых сацыяльна-эканамічных умоў, захоўваючы знешнюю форму. | ru_RU |
