Пределы реализации конституционных обязанностей государства в контексте целей социально-экономического развития страны

Abstract

Рассматриваются вопросы реализации конституционных обязанностей государства в условиях его нацеленности на восстановление устойчивого экономического роста в Республике Беларусь и приближение уровня и качества жизни населения страны к развитым государствам мира. Исходя из корреляции прав человека и обязанностей государства анализируется вопрос об объеме конституционных обязанностей государства и формах их реализации. Отдельное внимание уделяется пределам реализации конституционных обязанностей в сфере социально-экономических отношений, а также факторам, их определяющим. Поднимается проблема поиска баланса и границ в соотношении обязанности государства по регулированию экономической деятельности и обязанности воздерживаться от чрезмерного вмешательства в экономические отношения в силу закрепленного в Конституции принципа экономической свободы. В общем виде устанавливаются факторы, предопределяющие пределы реализации конституционных обязанностей государства и влияющие на ее эффективность в социально-экономической сфере.= The article is devoted to the issues of realization of the state’s constitutional duties in the context of restoring sustainable economic growth in the Republic of Belarus and bringing the level and quality of life closer to the developed countries. Based on the correlation of human rights and the state duties, the issue of the scope of the constitutional state duties and the forms of their implementation are being considered. Special attention is paid to the limits of the constitutional duties implementation in the socio-economic field, as well as the factors that determine them. The problem of finding balance and borders in the ratio of the state’s obligation to regulate economic activity and the duty to refrain from excessive interference in economic relations is raised due to the constitutional principle of economic freedom. In general, the factors determining the limits of the implementation of the constitutional state duties and affecting its effectiveness in the social and economic sphere are established.
